One of the main objectives of DESIGN YOUR SKILLS SRL, located in Dej, Aleea Ceferiştilor Street, No. 8, Block A3, 1st Floor, Apartment 8, Cluj County, is to ensure the confidentiality of your personal data, both as a data controller and as a data processor. This document aims to inform you about the processing of your personal data by our company.
2.1. If you are a client of the company, DESIGN YOUR SKILLS SRL will process your personal data, such as your first and last name, email address, postal code, details related to your bank account, date of birth, phone number, IP address and any other categories of data that you directly provide in the context of creating your user account or in any other way resulting from the use of the Site.
2.2. If you are a business partner and/or an employee of DESIGN YOUR SKILLS SRL, only the personal data that you provide directly will be processed.
If you
are an employee, business partner, or customer of DESIGN YOUR SKILLS SRL, your
personal data is processed as follows:

3.1. for the execution of the contractual relationship between you and DESIGN YOUR SKILLS SRL, that is, for the proper performance of the collaboration agreements concluded.
Grounds: The processing of your data for this purpose is grounded in the contract established between you and DESIGN YOUR SKILLS SRL. Providing your personal data is necessary for the execution of this contract. Refusal to provide data may result in the inability to conduct the contractual relationships between you and DESIGN YOUR SKILLS SRL.
- 3.2. for the fulfilment of the legal obligations incumbent on DESIGN YOUR SKILLS SRL in the context of the services provided, including tax obligations and archiving.
Grounds: The processing of your data for this purpose is necessary based on legal obligations. Providing your data for this purpose is necessary. Refusal to provide data may result in DESIGN YOUR SKILLS SRL's inability to fulfil its legal obligations, thus rendering it unable to provide you with services.
Providing your data for this purpose is voluntary. Refusing to provide consent to the processing of your data for this purpose will not have any negative consequences for you.
Essentially, DESIGN YOUR SKILLS SRL will process your personal data only to the extent necessary to achieve the processing purposes mentioned above.
If you are a customer, we will process your data for the entire duration of the contractual relationship and subsequently in accordance with the legal obligations that DESIGN YOUR SKILLS SRL is required to follow (e.g. for financial and accounting documents, the legal retention period is 10 years from the end of the financial year in which they were prepared).
In the event that you are a customer and choose to delete your user account, we want to inform you that deleting the account will not automatically result in the deletion of your personal data. If you wish for your personal data to no longer be processed or if you require the deletion of your data, you can exercise your rights as detailed in Section 7 below.
To achieve the processing purposes, DESIGN YOUR SKILLS SRL may disclose your data to partners, third parties, or entities that support DESIGN YOUR SKILLS SRL in its activities, or to central/local public authorities, in the following cases listed by way of example:
- for the Site administration,
- to
maintain, customize and improve the Site and the services provided through it;
- to the
LearnWorlds platform by accepting the terms and conditions,
- when
the disclosure of personal data is required by law, etc.
Personal data provided may be transferred outside of Romania, but only to states within the European Union.
In accordance with the legislation regarding the processing of personal data, as concerned individuals, you have the following rights:
- 7.1. the right to information, that is, the right to receive details of the processing activities carried out by DESIGN YOUR SKILLS SRL, as described in this document;
- 7.2. the right to access the data, that is, the right to obtain confirmation from DESIGN YOUR SKILLS SRL regarding the processing of personal data, as well as details of processing activities such as the way in which the data are processed, the purpose for which the processing is carried out, the recipients or categories of recipients of the data, etc;
- 7.3. the right to correction, that is, the right to obtain the correction, without undue delay, by DESIGN YOUR SKILLS SRL of inaccurate/unjustified personal data, as well as the completion of incomplete data; the correction/completion will be communicated to each recipient to whom the data was transmitted, unless this proves impossible or involves disproportionate efforts.
- 7.4. the right to have the data erased, without undue delay, ("right to be forgotten") if one of the following applies:
- they
are no longer necessary for the purposes for which they were collected or
processed;
- consent
is withdrawn and there is no other legal basis for processing;
- the affected individual objects to the processing and there are no overriding legitimate grounds;
- personal data have been unlawfully processed;
- personal
data must be deleted to comply with a legal obligation;
- personal data were collected in connection with the provision of
information society services in accordance with EU or national law under which the controller is operating.
- 7.5. the right to restrict processing to the extent that
- the person disputes the data's accuracy, for a period that allows us to verify the accuracy of the data;
- the
processing is unlawful, and the data subject opposes the erasure of
personal data, instead requesting the restriction of their use;
- the
controller no longer needs the personal data for processing purposes, but the
data subject requests them for establishing, exercising or defending a legal
claim; or
- the
data subject has objected to the processing (other than direct marketing), for
the period of time during which it is verified whether the legitimate rights of
the controller prevail over those of the data subject.
- 7.6. the right to data portability, that is
- the
right to receive personal data in a structured, commonly used and easily
readable format, and
- the
right to have such data transferred by DESIGN YOUR SKILLS SRL to another data
controller, provided that the conditions laid down by law are met;
- 7.7. the right to object - in relation to processing activities, may be exercised by submitting a request as indicated below;
- at any time, for reasons relating to the data subject's particular situation, that data relating to him or her are processed on the basis of the legitimate interest of DESIGN YOUR SKILLS SRL or on the basis of the public interest, except where DESIGN YOUR SKILLS SRL can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of data subjects or where the purpose of the processing is to establish, exercise or defend a legal claim;
- 7.8. the
right not to be subject to an automated individual decision, respectively the
right not to be subject to a decision taken solely on the basis of automated
processing activities, including profiling, which produces legal effects concerning
or significantly affecting the data subject;
- 7.9. the
right to address the National Supervisory Authority for Personal Data
Processing or the competent courts, to the extent you deem necessary.
